Where alcohol is the primary business rather than an accompaniment to food, the risk profile changes sharply. Carriers look at the ratio of liquor to food sales, closing times, whether there is live entertainment or dancing, and how security is handled. Getting the placement right means finding a carrier that writes this class deliberately rather than one that tolerates it.
The Texas Dram Shop Act makes a provider potentially liable when alcohol is served to someone who is obviously intoxicated to the point of presenting a clear danger to themselves or others, and that person then causes harm. The claim is brought against the venue, not only the drinker.
Texas also provides a safe harbour defence connected to TABC seller-server training and to the employer having required and not encouraged violation of it. Keeping every server certified and the records current is both a legal defence and something underwriters price favourably.
This is the exclusion that catches bar owners hardest. Many general liability policies written for alcohol-led venues exclude assault and battery entirely, or sub-limit it well below the policy limit. A fight in the car park is one of the more predictable claims in this trade.
